The Immigration Appeal Division overturned the decision of a visa officer who refused to issue the Appellant a Permanent Resident Travel Document due to the fact that he had not been in Canada at all within the 5 years prior to the determination. The Appeal Division determined that there existed sufficient humanitarian and compassionate grounds to warrant a decision to grant special relief.
